These Terms of Service ("Terms") govern your access to and use of the emonster.games website, its game catalog, links to emonster games and product websites, and related software products offered by emonster, inc. ("emonster", "we", "us", or "our") (collectively, the "Services"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Use of the Services

You may use the Services only for lawful purposes and in accordance with these Terms. You are responsible for complying with applicable laws.

You may not misuse the Services, interfere with their operation, attempt unauthorized access, scrape or harvest content without permission, infringe intellectual property rights, introduce malicious code, or use the Services to harm emonster, our users, or third parties.

Game Catalog and Product Information

emonster.games provides public information and links for emonster games. Availability, compatibility, features, prices, advertising, and in-app purchases may change. The current App Store listing and any product-specific website or disclosure control for the applicable game. A catalog or product link does not create a support or service agreement.

Apps, Software, and Purchases

emonster games and software may be distributed through Apple. Downloads, purchases, in-app purchases, refunds, and marketplace entitlements are handled by Apple and are subject to Apple's terms in addition to these Terms.

Some products have additional product-specific terms, privacy disclosures, or license agreements. If product-specific terms apply, they supplement these Terms.

Intellectual Property

The Services, including websites, software, apps, designs, text, graphics, code, product names, logos, trademarks, service marks, inventions, patents, and related content, are owned by emonster or its licensors and are protected by intellectual property laws. Except as expressly allowed by these Terms or a written agreement, you may not copy, modify, distribute, sell, sublicense, reverse engineer, or create derivative works from the Services.

Feedback

If you email ideas, feedback, bug reports, suggestions, or similar input, you grant emonster a worldwide, perpetual, irrevocable, royalty-free right to use that feedback without restriction or obligation to you.

Third-Party Services and Links

The Services include links to Apple and App Store listings, product websites, and other emonster portals. emonster is not responsible for third-party services or their content, policies, availability, or practices.

Disclaimers

The Services are provided "as is" and "as available". To the maximum extent permitted by law, emonster disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and security.

Limitation of Liability

To the maximum extent permitted by law, emonster will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, business interruption, or loss of goodwill arising out of or related to the Services. emonster's total liability for any claim will not exceed the greater of the amount you paid to emonster for the applicable Service in the three months before the claim or USD $100.

Indemnity

You agree to defend, indemnify, and hold harmless emonster, its officers, directors, employees, contractors, and agents from claims, damages, liabilities, losses, and expenses arising out of your use of the Services, your violation of these Terms, or your violation of law or third-party rights.

Changes and Termination

We may update, suspend, discontinue, or restrict access to the Services at any time. We may update these Terms by posting a revised version on this page. Continued use of the Services after changes are posted means you accept the updated Terms.

Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles, unless a written agreement with emonster states otherwise.
